ASAN publishes a document list for marriage registration, while the timing, document treatment and eligibility of two Indian nationals need confirmation for the actual couple. One possible format is to complete civil registration separately and celebrate in Baku; this page cannot choose the legal route for you.

Why civil registration needs a separate timeline check

ASAN provides the civil-registration service. The Family Code describes a standard waiting period between application and registration, with exceptions for specified circumstances (Articles 9.1–9.3 and 172.2). Documents, translations and medical certificates also need checking. Do not assume this process fits the same dates as a short wedding trip or an e-visa stay.

The US Embassy in Baku has described an approximately two-month process and a residence-permit question for foreign applicants, but its page was last modified in August 2024 and we could not reconcile every detail with the Family Code. Treat that timeline as an older reference, not an answer for your booking. Obtain the current requirements and earliest registration date from ASAN for both people before paying for a venue or flights.

What does the Family Code say about foreigners marrying in Azerbaijan?

It sets conditions, not a nationality bar. Article 146.1 puts the form and rules of marriage under Azerbaijani law; Article 146.2 says a foreigner's conditions for concluding marriage are judged by their own country's legislation plus Article 12. Article 12.0.3-2 bars marriage only where a party is unlawfully present. Nothing in the Code requires an Azerbaijani spouse.

The rest of the Code fills in the general shape. Marriage age is 18 for both parties (Article 10). The medical-certificate requirement appears in ASAN's document list and the Family Code. Article 9.2 allows a shorter or longer wait for valid reasons, while Article 9.3 addresses specific urgent circumstances. Article 148.2 addresses marriages concluded between foreigners outside Azerbaijan under their applicable law; whether it applies to your documents needs qualified advice.

What ASAN asks for, and what it costs

ASAN publishes the list: written applications from both parties, ID documents, a legalised marital-status reference from the competent authority in the foreigner's country, a divorce or death certificate where either was married before, the medical certificate, and the state-fee receipt. The state fee is 5 manat, roughly 3 US dollars, checked on 10 August 2026.

The document chain is where Indian couples lose weeks. Azerbaijan acceded to the Hague Apostille Convention on 13 May 2004 and it has been in force here since 2 August 2004, so an Indian civil document does not need consular legalisation; it needs an apostille from the issuing state and then a translation into Azerbaijani. Apostille and legalisation on the Azerbaijani side is handled by the Ministry of Foreign Affairs at ASAN Service Centre No. 5 in Baku. None of that is expensive. All of it is sequential, and sequential is what kills a wedding-week timeline. The service page for state registration of marriage carries no visible revision date, so confirm the list at the centre before you build a schedule on it.

The one question we cannot answer for you

Whether ASAN will register a marriage where neither party is an Azerbaijani citizen is not settled in any source we can point at. The Family Code carries no such bar. The US Embassy in Baku describes the procedure only for a foreigner marrying an Azerbaijani, and states that foreign citizens need a temporary residence permit. We cannot reconcile the two.

Two gaps sit inside that. First, the residence-permit requirement does not appear in the Family Code passages cited here, so this page cannot establish the rule for an e-visa holder. Second, we found no government page that clearly answers whether two foreign nationals may register together. If you want civil registration in Azerbaijan, contact the ASAN service centre handling civil status acts and your own embassy or qualified adviser before you book anything. Ask for the requirements for both people, accepted immigration status, documents and earliest date in writing.

Once the legal step is off the table, the Baku programme gets simpler rather than poorer. The mehndi, the sangeet, the haldi, the baraat, the pheras under a mandap and the reception all run exactly as they would anywhere, and nobody is watching a notary's clock during the sangeet. Do not book a Baku date on the assumption the legal registration happens there. Do not start the Azerbaijani civil route on a 30-day e-visa until the residence-permit question has been answered to you in writing by ASAN or your embassy, because that is the step that fails quietly and late. And do not take a wedding-planner blog, ours included, as authority on which documents your registrar in India will accept; registrars vary by state and the list you need is the one your own registrar gives you.
